I was in an IVA for four years, but because of a change of employment and lower income, I had a meeting with my creditors to reduce my payments, and in return, the IVA was extended to Five years. However, because of continuing ill health (heart attacks) and various other ailments, it was possible that my employer would not accept my time off from work, and I was worried that i may not be able to keep the payments up to date, I informed my IVA providers DFD. and they arranged a meeting with my creditors, who accepted the fact that my payments were possibly going to end, they accepted a final settlement figure from me, and my IVA finished in January 2012.
However, I had a claim for PPI going through at the time, and I fully understood that whatever figure I received would be off set against my IVA. The amount I received, was in excess of £21.000. and that went (as I thought) against my debt.
It has been a year now since my IVA was supposed to have finished, BUT The bank has taken the money back against my debt with them, and have NOT paid it into my IVA funds.
I was advised by DFD to use a company called Equity in Finance, which i think may be a subsidary of DFD, But not sure.
I feel that Equity in Finance should be chasing up the matter over the Bank witholding the money for themselves.
I have not had any real response from either DFD or Equity in Finance, each blaming each other. In the meantime, I am in limbo, as I have done ALL I can do, and have in my mind paid my debts, and can do NO MORE in the matter.
I desperatly want my clearance from my IVA, as because of my health problems (I am now having tests for throat cancer), I do NOT want to die in debt.
Can anyone PLEASE advise me as to where i can go to complain about this, do I go to the Financial Ombudsman, the Courts, or is there somewhere else i can go?

Hi Warren firstly I'm sorry to read of your ill health at present and hope that you are in better health soon.

With respect to the PPI, I will bump this back up and hopefully one of our experts will comment.x

The bank is probably entitled to exercise set-off in the manner they have applied, but if your IP feels this has not been applied correctly then they may well look into this further. Either way, this issue should not be delaying the closure of your IVA.
