Hi! I just have my 1st review this january, and my IP suggested that i have to pay additional 242 pounds, I already paying them £457 for the credit of 42,000 pounds. my surplus income is just the same as last year which is £292. i have an extra night shifts and weekend enhancement from work now and again, but this is not a regular basis. is this additional payment is fair? or what can i do to challenge this decission? can i change my IVA company if Im not happy too?

I put only £500 expenses for food,house hold & cleaning. which is I feel its short for the 3 members of family in a month.

Hi there and welcome to the forum
If your basic salary has not increased, and your expenditure has not reduced significantly, how is your IP justifying this. I assume that you are only required to increase your payments by 50% of your increased disposable income in any case, but please clarify if this is the case.

It was a joint IVA, we only declare £1500 salary for me last year as that is my basic pay, but for the whole 2012 Ive got to covered night shift and weekendin work.that make my income over £300 a mo. and its also shows in my P60, but after my review they says that by looking on my pay slip they need to increase the monthly payment of 242 pounds, which is i personaly believe its to high and i cant afford it just incase i lost my enhancement. your also right about only 50% they can take to my surplus income. the only time they talk to me is when they needing an extra charged on my payment. do i have any options on changing my IVA practitioner?

Reviews should only take account of basic salary, unless you have enhancements which are paid regularly and are guaranteed. I think you need to query this with them some more. Which firm are you with?

Hi
I agree with Mel, you should only be paying 50% of any earnings above you basic net figure plus 10%, so anything above 1650 should be split 50/50 and paid into your IVA as an extra payment.
It is dangerous to include new shift allowances in your basic pay in case these stop

After my first annual review my payments increased by £175 a month (from £600 to £775) even though there was no change whatsoever in my income or expenditure. After my second annual review my payments increased another £200 a month, but no issue with that as shortly beforehand I'd returned to a 5 day working week after a long period of a forced 4 day week.
What I've found more odd is that whenever I used to submit my payslips every quarter there was always nothing extra to pay, even when I was restored to a 5 day week for a while prior to my annual review. But in the last year or so my IVA seem to be after every penny they can get (a whole £8 last time around !).
Which as such I have no problem with, but my impression is that in the early days of my IVA I was given a considerable degree of 'freedom' (e.g. the initial payments of £600, the continual quarterly payslips reviews passing without any surplus being asked from me), whereas even getting halfway through my IVA they have been after every penny.
Surely in the case of the opening poster their additional income should be been picked up during quarterly payslip reviews and the appropriate level of surplus payment requested at the time, given there's clearly some surplus to pay ?.

Pavel, there is a difference in the way certain income increases are treated: If, on the quarterly payslip submission, they picked up an overtime payment or bonus, a proportion of this would have been payable immediately. However, in the case of a regular increase in pay ( pay rise)the increase isn't catered for until the month after the review.
As an aside, I am gratified to see that it is not just me that has the impression that IP's are hardening up.

I just receive a letter today, asking me to call this number 08000933757, they are saying that there other legal options to clear or reduce my debts. its about DEBT Relief order. is this for real? or just a con?

Hi carol I already send another e-mail yesterday 12 of jan. and phone the costumer service, I manage to speak with Bryan, and he said that he,s one on the review team, kindly get in touch with him as he promised to have another look on my increase payment. thanks for the effort i do appreciate it.
