i work as a finance officer in acollege and
stared a iva in may 2010 so half way through
a persoon took it on them selves to write to mmy company stating that surely "someone who cant look after their own finaces should not be allowed to control the college finances".there is no clause in my contract about debt or such and i have been here 10 years.im worried that now they know they will seek to fire me

Hi and welcome.
You need to speak to your HR to see if there is anything that means that you cannot be in an IVA. Hopefully there is not.
How did this person find out and have HR contacted you at all?

Welcome to the forum Roy. Quite a number of top end jobs i.e. Police, Lawyer, would not employ a bankrupt but are more lenient towards an IVA but there are exceptions. Are you a Chartered Accountant?

If there is nothing in your contract it is none of your employers business ( nor this informant's!).
As for his or her comments -- you are looking after your finances, by sorting them out responsibly.
Banks and Governments get in a mess .. what is so alarming about individuals doing it ?
There is also every chance that this informant is upo to the hilt in debt too.

Hi Roy, I doubt there will be anything in your contract that could trip you up. If you are doing your job well without any problems and managing the finances to an expected level, then what goes on in your personal life should not be of any concern to your employer.

Police Forces are much more lenient towards those who are insolvent as long as they are informed and some accountancy firms have no problems either.
As Foggy says, as long as it is not in your contract then no need to tell them.
I rather think this person has trawled the register - why would they do that unless they are in the mire as well?

Surely being in an IVA proves that you can look after your finances, you got into financial trouble and have taken steps to clear your debt. Nothing different to what the Banks did, other than you didn't defraud your statement of accounts or beg the money off the tax payers of this country and the figures are infinitesimal compared to the billions the Banks had to beg for.

I suppose anyone can type an individual's name in the Insolvency Register search. If you know a few basic details about someone, it's dead easy.

Until I became insolvent I had never heard of the register.

Hi and welcome to the forum. Some people have nothing better to do than cause problems for others.
I hope it causes you no problems and well done you for taking charge of your debt problems as like the rest of us you're doing your best to remedy them. I work in a college (teaching) and never thought before entering the IVA there may be a clause in my contract (still not looked).
When I read the application to pay course fees for learners a few months back now I did notice that it says 'not in an IVA' on it! however, doesn't mention bankruptcy which I thought odd but didn't question as I don't want to highlight anything!

Unfortunately, all it takes is a too-well informed sad case (a vindictive colleague or student for example), and I'm afraid there you have it.
Lots of people do know about the IR. Personally, I think all the insolvency service has to do is make a small charge to do a search. My guess is even 50p a go would deter the nosey parkers of society.

I knew about it long before I even contemplated an IVA, but that's just cos I'm a nosey so and so, I'm sure there are plenty of people out there who will have a nosey around the internet and stumble across it
