Hi.im looking for some.helpfull advice.me and my husband started a joint iva back in sept 2008 we have paid in 18,000 to date in april me and my husband split up and he is.now renting a flat .we have both completed our expe reports.and we said we have nothing left to pay into the iva since our circumstances has changed they have come back saying between us we have a joint disposable income of 269 this is not the case in our eyez .what options do we have if we really.cant afford to pay into the iva anymore.we only have a yr left.

Hi shez and welcome to the forum

I am not clear why your IP feels that you have disposable income which you say you have not. Please get them to confirm their calculations so that you can confirm them with your own figures, and then arrange for a chat with your IP so that you can discuss the nature of any variances.

Hi melaine.THanks for ur reply.we have had nothing but nightmare with our ip since starting iva we havr had 4 diff relationship managers and everytime get a new one we arw back to square one .they lose every six months wage slips have to go over stuff all the time endless stress.we adviced our ip on march about or situation supplied all the info they needed to prove our half paying rent and his bills and now in aug they have started the nall rolling.i am fed up and stressed as.after we showed them our new.exp reports they have paid no attwntion to my new one and said that ifwe cant afford payment then we have to writw a letter to see if end iva early.what happens if they say no as they tjink wr have 269 disposable imcome

I guess this highlights the need to find a good firm to act for you from the outset of the process. IVAs are not just about getting acceptance at creditors meetings, but sustaining a good working relationship throughout the process. If you don't agree with their assessment, tell them you will refer the matter to court. District Judges are quite sympathetic to the needs of individuals with regard to expenditure, and if you win you can claim costs against the IP.
