When making a full and final payment from money from a family member, if the offer is rejected will we still have to give half into the iva.

Hi ---- make it clear to your IP that the offer is from third party funds and is only available for the purposes of a full and final. If the offer is refused, the third party will retain the monies.

Totally agree with Foggy. No need to hand anything over if the F&F isn't accepted...you wouldn't have anything to hand over anyway! x

Absolutely not...ensure it is known it is only available for the use of concluding your IVA in full otherwise you will not have access to it.

Agree with everything said already, but intrigued as to why you might think you have to give over half the F&F if it`s rejected[?]

I am sure they can't take something which doesn't belong to you! The F&F is being given to you by a third party and is for that purpose only!

Fully agree. If when making the F&F offer stipulate that it is only available for the settlement. It is not accepted the offer will be withdrawn from you. Good luck

Hi

Just to confirm all other posts, the offer is made on the condition that it is used to conclude your IVA, if not accepted then the offer will be withdrawn by your family member
