I completed my IVA in 2009 and recieved my completion certificate early 2010. I am now selling my house and am near to signing contracts but my solicitor has raised an issue of a restriction on the sale of my house. I thought this would not still be in place after completing my IVA. Any advice ????

Hi and welcome I assumed this was moved upon completion of the IVA. Have you contacted the IP who dealt with your IVA to ask why the restriction is still in place. It's most probably just an oversight and one which can be remedied swiftly.

Hi thanks for your reply. My IVA was originally dealt with by a company called Wilson Philips/Accuma group. In 2006 my IVA was taken over by Grant Thornton as Wilson Philips went into administration ( how ironic ) but it is not the IVA supervisor from G Thornton who appears on the restriction but the previous one from Wilson Philips. Surely the restriction on Land Registry does not apply now, as I have completed nearly 2 yrs ago. I have all paperwork and certs to prove completion and G Thornton takeover. Can anyone advise. Thanks

It should certainly have been removed by now. You could try speaking to the land registry to see if a copy of your completion letter would be enough for them to remove it.

Think I will pass on all details to my conveying solicitor as that was the request I got from them. Hopefully they will deal with it.

Don I hope your solicitor sorts everything out for you and the sale of your house is sort you would like after two years everything would be sorted from you IVA

Thanks for the encouragement, it just seems to go on and on.
To anyone in an IVA " be prepared ", it does not go away when you have completed, you will have a lot more work to do regaining your sanity and getting rid of all the stress involved, but it will all be worth it in the end. I HOPE

I can only echo the others that it should have been removed. Speak to GT and see how they can help get the restriction lifted. x
