Oh well hear goes, a little ashamed over this one.Anyway, my IVA is basically down to a long term gambling habit. I have been in an IVA for a couple of years now & have rarely gambled expect the odd few pounds. Over the last few months the general grind of having little spare money has been really getting to me. To cut a long story short I had a bet which then lead to a lot more bets. Now I have got myself into the situation where I cannot make this months payment into my IVA. Would it be advisable just to come clean & admit my mistake or is this likely to put my IVA at risk etc.[:I]

Please do come clean with your IP and work your way forward with their assistance.

I do hope you don't think I'm judging as I'm not in any way (I have my food habit) but do get some help if you need it.

I am just so ashamed to what I have managed to do. Not sure if I dare take the risk that it could possibly put the IVA risk by coming clean. I have paid 26 payments out of 72 which it quite a way down the long hard road

If it means you missing this month only your IVA won't fail. You just need to let them know you can't pay and work a way forward to repay the missing month. Honest we're all here for various reasons and we're non-judgemental.

I have plucked up the courage to e-mail my IP. Seems a cowards way out not doing it over the phone. Hopefully, a couple of months payment break would put me right. Anyway just hoping it turns out ok as not sure what would do if its causes the IVA to fail.

I have received a reply from IP etc. I am sick to the bottom of my stomach. I am now in breach of my IVA & this could have severe consequences on it progressing. Any advice welcome.

Oh Mark I do feel for you... Please let us know how you get on and as lesley says, do get some help if you need it. This isn't being judgemental either, it is from personal experience. x

Hi Mark, being in breach does not mean an automatic fail. You need to discuss a way forward with your IP, to rectify the breach. All is not lost.

A sensible approach would be to give you the leeway to allow the payments to lapse by missing the one payment, which will have to be made up over a period of time to get you back on track.

However, and I am sure you know this ... I doubt the IP, or creditors, would look too kindly on a future lapse for the same reasons.

Humble pie doesn't taste good, but make sure your IP is aware that you are fully aware of the error of your ways. Sorry to sound like I am preaching, but you need to get him or her on side to help you through this blip ( which, in one form or another, befalls many of us).

Hi Mark - just keep on talking to your IP I guess. I'm pretty sure if you had the chance again you wouldn't have returned to gambling...so if it is just one repayment that you can't make, and you can argue your case to you IP that it won't happen again, seeking gambling help maybe? etc then I would hope they would work with you. My own situation is largely down to my thinking I could gamble my way out of financial trouble but I couldn't...Please don't give up and keep talking to your IP. Good luck.

I do personally think the IP is being a little unfair here, it's all very well telling the OP he has breached his IVA and this could have severe consequences for the IVA progressing, but what about a constructive response for goodness sake??? that doesn't help the OP at all in how to try and rectify the situation.

Thanks for kind words & support etc. Just got off phone with a nice chap in the office. I am hoping a little common sense is going to prevail. I have sent evidence I am going to attend counselling. I have requested a couple of months payment break to get myself sorted with the intention to pay back the missed amounts through any overtime or extra income etc.
It has to go to the IP to be looked at. Here's hoping for the best!!!
