My partner had a phone call from a pay day loan company who he owes money to. They were in his list of creditors and our IVA was approved last month. They have now told my partner that they are going to apply for a CCJ and get money taken directly out of his wages if he doesn't pay or make offer of payment. My partner explained that he is in an IVA. They said that they are not aware of this and he has two weeks. They cannot do this can they? I'm going to ring our IP tomorrow too.

Hello,
They cannot do that as you are now in your IVA.
Speak to your IP and they will sort this out for you.

No I don't think they can. Once your IVA is approved you are protected from your Creditors x

Hi, they are trying to blag the money off you. This is contrary to the terms of the IVA and I suggest you ask your IP to have a word in their shell - likes and suggest that tyheir licence might be at risk if they persist in harassing you.
BTW -- they will be listred in your Chairman's Report, but whether they voted or not, they are bound by the IVA.

Thanks everyone. Just spoken to my IP. Looks like they didn't bother to vote, she said it takes 4-6 weeks to filter down to all the creditors notifing that we are in an IVA but they are going to send them a letter.

hate them payday loan people with their 100000000000000000000000% interest,dont answer the phone to them,like foggy said,they are trying it on hoping youll get scared and offer them some money,they took the risk lending it to you at their 100000000000000000000% and this time the risk never paid off for them,

Can you say which company its with, I am waiting for my IVA meeting and have some payday loans on my list.

We have a few between me and my partner but the one in question is Quid Market. Not one of them bothered to vote.

As others and your IP have said they can do nothing, just using scare tactics etc.,

It's worth letting your IP know about any correspondence so they can keep a track of it and possibly even inform regulators where there are serial offenders!

Its not just payday loan companies.
I still get demands from HMRC for an amount included in my proposal.
GT did sort it for me last time but they still write now and I expect them to write long after my IVA is completed.
I just shred them now, they havent got a leg to stand on.

I have received by email a default notice by Wonga and Quick Quid, Do I need to act on these or should I wait until my IVA meeting next Wednesday 27th June???
