Hello,
I've been in a 5 year IVA since September 2010, I recently receives compensation through CRIMINAL INJURY COMPENSATION AUTHORITY it was for a serious assault that happened to me at work.
Are the IVA company allowed to take this money from me for my creditors?

Hello David
Not sure about how you stand with this compensation - you need to speak to your IP about your conpensation, It will depend upon what your agreement says.

It all depends on your proposal.
The pain and suffering element of compensation can usually be kpt but proposals do very on this point. Have a chat to your IP and see what they advise.

Thank you for the advice. My IP currently has no idea where I stand with it. I will let you know how it goes.

Have you actually checked with the IP directly or just the office staff? Your IP should be able to tell you - insist on speaking to them.

Hi all,
Great news just spoken to IP and I'm allowed to keep the whole amount awarded! But as stated in my insolvency package there are rules. Am not allowed to buy anything big like a car it house deposit, it has to be used to help make my life easier.

I wonder how your IP intends to police that David! I agree with the decision, just think that you have been quoted terms that would be difficult to insist on, given that the payment falls outside the scope of the IVA.

Melanie, I was thinking the same, the only way I could think was when my review is due in September ask for my bank statements.... is that allowed?

Bank statements can be requested, we had to provide bank statements at all of our reviews.... a holiday for rest & recouperation sounds like it would make your life easier. Congratulations on being able to keep your compensation.

They can ask you for your bank statements - but having given you the red light to keep the money, it is rather ineffective of them to then want to investigate how you have spent it!
