I was wondering whether any of you have any experience of claiming PPI after completion of an IVA. I have completed my IVA & have a completion certificate. I therefore no longer have a debt.

I was missold PPI on a credit card & loan with Mint. It was mis-sold to me for a number of reasons.

I am wondering whether anyone has had any success with this? I paid PPI for a number of years on both accounts before i defaulted, & the creditors have now been paid & the debts settled as part of the IVA.

I would appreciate any advice from people who have been in the same situation.

Just go for it Poppy, there have been posters on here who have reported successful claims after their IVA had finished. If successful they have no legal right to keep it and say it is to set off the original debt, as this debt no longer exists. Don't get a PPI firm to do the leg work as they charge upto 40% for doing something that will take you 30 mins.

If you are going after a PPI refund the best advice is to do it yourself with one of the many template letters out there as you will keep the full claim, don't use the services of a company if you can help it as the fees are quite high and if the claim is small you may have to pay any excess.
If you win your claim then the money is yours, the company may say they are taking it to offset any debt owed to them but as they have been paid from your IVA they have no debt to offset it against. If you get a letter from them saying they are going to offset the debt then write back to them saying you don't accept this as there is no debt to offset against, and to reconsider their decision. Give them 14 days to reconsider and if they don't pay up inform them that you will take matters further.
The longer it takes them to pay the more interest is added.

I am anticipating some arguements due to the historic IVA but you are right, there is no debt for them to set off against.
