Hi Guys

Ive just been accepted for an IVA, still need to sign and send the RX1 Form back- however as my ex's name is still on the Mortgage (that he doesnt pay) he needs to sign this Form, he is being rather awkward....what happens if he refuses to sign it??

Hi Cal - welcome to the forum - to be honest I am not sure but its best you go back to your IP and explain the problem you are having to see what can be done.

I hope your ex doesn't spoil things for you, maybe one of the other posters has had a similar experience and can let us know.

Thanks Tina, he is the reason Ive had to do the IVA in the 1st place, left me with his Debt- what a Gentleman!

Hi Cal, have you received the form off the land registry as a restriction on the property becuase of debts owed to one of your creditors?

Hi Vimto

Oh I dont know, I just thought it was because of my Mortgage, I would need permission from the Land Registry if I was to try and sell up within the IVA...

we never recieved the form ? so our property was never registered .

Oh, i'm not sure then i'm afraid. I think it depends whether there's loads of equity in the property?
I've had a similar issue with mine in that i own my house with an ex and have been trying to sell to get away from him lol. My IVA people have been pretty helpful about it all to be honest so i'd maybe suggest seeing what they say? Hope that kinda helps? Sorry if it doesnt :-S x
