I made my last payment in September 2011 to debt free direct. I then recieved a letter the week before christmas from Equity in Finance on behalf of Debt Free Direct to claim PPI. When I contacted DFD I was told i had to claim PPI as I had an obligation to claim as much money back as possible to pay back to my creditors. I was forced into completing the claim form. I subsequently contacted Equity in Finance to ask who would get the PPI claim as I had in fact finnished my IVA. I was told it would be a private claim and it would come to me. By January, I still had not heard a thing from DFD, bearing in mind, I finnished paying in September the previous year. I contacted DFD, to be told the PPI claim is holding it up. I wanted to complain and asked for a manager to call back. Another week passed, didn't hear a thing. I was then passed on to someone in the completions team to deal with. I was then told the PPI claim was holding things up, however I had in fact paid all monnies back that was owing. She decided to let my case close due to this fact. Weeks passed, still never got the certificate. Called up again, This time i'm told the PPI is in fact a private claim and always was. By this point I am totally confused and at the end of my tether. I was told 2 - 3 weeks to recive my certificate. Today is 19th March 2012 with no certificate to be told there is now a problem with VAT that DFD have not paid the right ammount or something along those lines. I have written a formal complaint. Heard nothing back. I want answers from DFD as I feel I have paid the monney and left. No letters, no phone calls. Just left in limbo. I don't know where to turn. Devastated is not the word. I have not run away from my debts, nothing has been written off so why can I not be released??!!! Help!!!!!!!

I was told this afternoon, it's being posted tomorrow, but I do not trust a word they say. I find DFD a disgrace and I am devastated with the way they have treated me. I have in writing that I will have my completion certificate within 2 weeks. That was 3 weeks ago. Still, nothing, not a word. All in meetings when you ring up!!! Sure they have meetings about meetings!!! Thanks again Jan, just so angry at the moment. I have extended it to 6 years aswel due to maternity, so this is my 7th year!!!!

Not good but Declan is usually great at dealing with posters and hopefully he will pick up on this tomorrow.

As predicted about not trusting, I was absolutely right!!!!! I have recieved a letter Rule 5.34 Notice of completion of Voluntary arrangement. This isn't even on letter headed paper. Due to the visual lack of officailness, I asked the question to the complaints supervisor at debt free direct "have I been released?" To which the answer was "No." Interesting? Maybe you should of told me that before allowing me to believe I had in fact been released? Although Debt free direct have in fact confirmed that all my obligations under the IVA have been satisfied, they are unable to release me due to a VAT issue which has recently arose. my letter states the following: "As discussed, I must however confirm that once the issue regarding the VAT has been resolved, a report will be issued to you confirming the dividend level etc that was distributed to your creditors." Debt free direct have a duty of care and a morale obligation to me as I have paid them a fee. Does anyone know what the vat issue is?????

If you have been issued with a Certificate of Due Completion, then the IVA has completed. You cannot be given a Certificate but then told that the IVA cannot be closed, as both events are simultaneous.

The VAT issue is complex and has been the subject of many discussions on the forum. It is slowly getting resolved, and a lot of IP firms have actually taken the decision to continue closing cases regardless of the issue. I sought legal and regulatory advice on this point, and was told there is nothing to stop my cases being closed, but whilst this may suit my firm it may not suit others as we are all structured in different ways.

I would advise you contact Declan again and ask him to clarify and to look at your case again - the completion certificate is just what you describe - it isn't on headed paper and it doesn't resemble a certificate - that is a myth.
If I recall what ours looks like it is a A4 piece of paper headed with the Court Name and Number, and then a small paragraph to say we had satsified our IVA and the supervisor was no longer involved in our case.........this is the certificate !

Have you checked the insolvency register to see if you have been removed from that - that is also a sign that your IVA has formally closed ?
