I've sent several requests now to tesco bank at their various addresses along with my completion certificate to update my credit file since early january and they are the only ones who havn't updated, all the rest have kindly have. They seem to be ignoring me or not being very co-operative, please help.

Hi Jason,

Tesco are notoriously bad at doing this, I believe Skippy is still trying to sort them out from her bankruptcy.

Keep on at them, make sure it's the data controller you write to and tell them that they should update the file within 28 days or you will take the matter further. Make sure you send the letter recorded delivery.

Tesco are a nightmare - they are still defaulting me 5 years after I went BR. They ignored my previous emails so I'm going to write to them again giving them 28 days to action the changes or else I'll be referring them to the Information Commissioner.

Good luck, I hope you cna get this sorted out.

Give them 1 more chance then as the other have said, then escalate the complaint. It has to be the data controller you write to but I'm sure you already know that!

I dread to think what's on our credit file, but have never looked at it and won't until it's time to clean it all up, then the fun begins!!!

To be honest I think it'll have to go all the way to the Information Commissioner as Tesco are a law unto themselves - they told me they don't recognise bankruptcy when they phoned me for a payment!

Complain to the credit reference agencies directly. They have a duty to ensure the data they hold is correct, if it isnt or is in doubt and Tesco dont respond then they have a duty to suppress the data from their records. Put it in writing and the credit reference agencies will do the rest. If the default date is correct then it will drop ff anyway after 6 years so there may be little point getting it amended, a settled default or an unsettled one are just as bad for your credit score and both drop off 6 years from the date of default.

CRAs have 28 days to respond the ICO can take months even years to resolve the matter.

If the CRA does not respond then the ICO should respond as soon as you contact them.

As far as I'm aware the correct course of action is to write to the data controller giving them 28 days to respond. If they fail to update the information then you can escalate the complaint to the Information Commissioner.

Point 41 of the ICOs guidance states you have a right to take it up with the CRA directly, the ICO will ask you to do this before escalating a complaint.

I can't see anywhere in point 41 that states you have to ask the CRAs first. However if that's the case I think it's appalling - why should we have to write to 3 credit reference agencies when the ICO are supposed to regulate creditors. Callcredit can't even get the basic information correct so I'm sure they aren't going to be bothered about late defaults!

The ICO told me I had to first refer it to the CRAs as I was in dispute with them as well and then refer the complaint to them. The CRAs did frce the creditor to update the information quite quickly after I had done that. I got told the ICO had a case backlog of 6 months so I am glad I did.
