Glad I came back on my site as I just found out that I may be able to recover my VAT back from my supervisor that is if I can find him. Looked at their web site and found he is no longer there so a call to ICAEW will be required and a nice letter to his firm that he worked for is in order I think! I have worked out my ex and I could be entitled to a figure of £1,000 so worth claiming. Perhaps those who made a full settlement should start persuing as well!!!!

I don't think you will get the VAT back - your creditors/IVA company may do.

If your IVA has closed, your former Supervisor may decide to apply for a refund of the VAT which was charged during the last four years. If HMRC agree to repay the money, and you effected a return of 100p in the £ to your creditors, then you may be entitled to claim a refund, however if the return to creditors was less than 100p then creditors are most likely to be the ultimate beneficiary - although this is yet to be tested. Your former Supervisor does not have to make the claim, although I think that most firms are as creditors are telling us that this is what they expect us to do.

Which firm were you with as a matter of interest?

Hi Melanie Nice to hear from you and thanks for the pearls of wisdom!!! Trust you are well! I paid 100% as we had to sale the house in 2007 and what really caused a major problem was that we were liable to a statutory interest but you strongly advised us to vary the IVA which we did and thankfully our creditors agreed. By them agreeing and being paid 100% I do think that there is an amount due back but of course would be interested in your view on this. My firm was Grosvenor Partners based in London. They were quite a smallish firm. Not sure they are still doing insolvency as my supervisor is not listed. I shall call ICAEW to find out his whereabouts tomorrow!

Was your IP Mark Bassford? If so, I know him very well and would be happy to signpost you to him. So far as I am aware he is still with the company.
