Have had another letter - this time from solicitors asking me to settle debt with RBS. Despite a letter from my solicitor. also me sending to Grant thornton. They have said they are prepared to take less than the sum asked for by RBS. When I spoke to GT, the lady told me that RBS had not bothered collecting any money from them for 2 years. Yet here they are using debt collectors - who I am sure must be costing them money to pressure me for payment. I give up. your advice please

if they are listed in your IVA, then tough - you don't owe them a penny! surely though if RBS hadn't of been collecting the money for 2 years, what have Grant thornton been doing with it?? don't they have an obligation to still send the money to them? if not, can that money be given to your other companies you owe money to?

Hi Anyen,
You are completely covered if RBS are listed in the original IVA proposal.
I would be forwarding this letter to my IP and asking them to sort if I were you.

My understanding is that if they are included in your IVA then you are fully protected. As to when RBS decide to claim their pot of the money is up to them, but they can if they choose wait until the last minute - the money has to be kept for them by your IP and cannot be divided amongst other creditors.
