Good Evening all...
i have a question, before my IVA (that i have now completed..woohoo) i obviously had a lot of debt through loans and credit cards.....
I am entitled to try and claim back any of the PPI if i had any on these accounts i previously had?

Hi Coach,
If you believe that you are entitled to claim now that you have completed then go for it.
Be aware that you may encounter fees if you use any claims companies.

The problem here is that the forum is following double standards.
A person who has completed and IVA is being given good luck to go and claim PPI which they would keep 100% minus fees and we have numerous complaints of people reaching the end of their IVA who have to submit all their PPI claims and give POA before they get the completion certificate?
This is a farce?

i will keep you posted, if i am successful with it i will be urging others to follow suit.
During my IVA i was trying to claim the unfair bank charges, i was declined but GT did say to me i was ok to claim, and if i did get anything back, they would class it as a windfall and it would be a 50/50 split. As agreed in the contract.

herbekj...i have to disagree with you there! After a very hard 5 years, and being unfairly charged for several things by the banks which really helped push me into the IVA, i feel that i should have a go for it. If they say no, oh well, i lost the price of a stamp!
Everyone else is claiming for them, so why the hell should i not!

You may find creditors consider your accounts settled and are unwilling to repay missold PPI in addition to the money they have already written off. Could you not save yourself the trouble and take the write off in lieu of a claim?

They may well say that you are right, but its worth a shot surely!

I have never had PPI so not a problem for me, however, if the IVA is completed and certificate issued then there is no reason why the poster should not try and claim things back.
If you have been asked to provide information before completion then I agree, you should have to post details if you or your company think you have been missold. Once the IVA is over then you are free to claim this as you wish.

They may well decide not to pay out but that is down to coachjambo to pursue the claim.

exactly, thank you Kallis. I have consulted GT previously about reclaiming too, so i have gone down all of the correct avenues to ensure i am doing things in the correct manner

Herbekj, it is up to each individual whether to claim PPI or not. The issue with IP's forcing claims is that a)they are acting without the initial consent of the debtor and b) some PPI purchases were not mis-sold and therefore the claim is verging on fraudulent.
If, as an individual, you wish to claim, and are genuinely of the opinion that it was mis-sold that is the debtors own chioce, and good luck to any who wish to.
Personally, once I had been given the "gift" of having half my debt written off, I would not claim PPI, as I would have had more than that back in a) debt write off and B) being let off of the interest which might have accrued over the IVA term.
Once my IVA is complete I am drawing a line under all of the debts and they will be gone and forgotten.

Actually I agree with you.
I personally was going to let all this PPI stuff go past me when I have completed my IVA and put the past behind me.
But not now that certain IVA firms are now forcing people to sign POA to get there certificate of completion because they may or may not have been misold PPI and tell the IP company they were not missold it has annoyed me beyond belief.
I am now serioulsly considering making PPI claims once I have that certificate just to join the bandwagon.
I'm very sad actually that I have reached this conclusion.

Good luck to you if you can claim. It is down to the individual as to whether or not they choose to go down that route.
