back in 2008 i was told my iva had been mis sold back in 2005 as i did not own property
uk bankruptcy (now bankrupt) who advised me this took me through going bankrupt was about half way through the 5 years and they where going to a class action against my iva provider (free from debit)
can you tell if
1 i have a case
2 is there a time limit on it

I wouldn't say that not having a property to protect constitutes a mis-sold iva. I chose an iva and don't have any assets to protect and many of our posters in ivas rent. If this is the basis of their class action, I wouldn't be too confident about winning. Did you go bankrupt?

I agree - this sounds like one of the ambulance chasers who has convinced someone they would be better off going bankrupt.

There are an awful lot of our posters who rent.

Where is the five year figure coming from if you went bankrupt?

I interpreted it as the OP being halfway through a five year iva when he/she went bankrupt. I could have got the wrong end of the stick (wouldn't be the first time!)

I rent, and would have been financially better off going bankrupt, but chose to try to pay back as much as possible instead ... hence the IVA. If things go pear shaped in the meantime, there is still the BR option.

There is no way the ambulance chasers could claim I was mis-sold an IVA, as all options were discussed and I was provided with informative leaflets by my IP prior to signing up.

You're probably right - I did just skim the post.

What a shame if that is what happened. I'd say he'd got more of a case against the ambulance chasers rather than the IP company!!

It is a shame as it appears nothing ever came of the class action otherwise the the OP would have been involved and know the status of it...not trying to go it alone.

I somehow doubt the action was never commenced. This seems to be an ambulance chaser instigated out of the frying pan into the fire scenario. (I could be wrong).

Have to say that I seemed to get letters and calls every other week in 2008 about having been missold my IVA.
The first couple I passed to my IP.
Then I just binned the rest.
They were just ambulance chasing.
BR was not an option for me at the time as it would have cost me my job.

in 2008 went bankrupt now 2 yrs clear but only found out resently that one creditor still ahd me as default

i had put to the back of my mind thinking well learn from my experience but with all the miss selling ppi ads its got me wondering. At the moment if i was mis sold and had a case how much of the £8000 ish would i get back as having my car writting off (£650) before my banruptcy ive been struggling to get a car that is reliable as i need it for my elderly mother

if i had still ahd the iva i would be 4 months from finishing and 6 yrs for credit to improve at least in 2 yrs improving credit ratings all my trust was with my iva provider

uk bankruptcy .co.uk went under sonothing was done

6 YEARS FROM THE start OF AN iva OR BANKRUPTCY SO NO DIFFERENCE THERE.
