i have just had a letter from the tax man and i overpaid during 2009-2010. i started my iva on the 22nd of feb 2010, i have not cashed this check yet as i only recieved it this morning. Would this be classed as a windfall, if so would the payment be based on a pro rata payment into the iva as it was over payments made before the start of the iva.
Would just be very handy at these times if i could keep some of it

You have to check with your own ip as different iva's will deal with such a scenario in differing ways.

Maybe owe a bit of it for the last two months you have been in the IVA?
Only your IP is gonna give you your answer but its always worth trying to get a little bit if poss, as every little helps!!

had a look through my modifications and any windfall under £500 i get to keep but just waiting for my ip to confirm

Hi we had the same thing a couple of weeks ago and we were allowed to keep it all as it was classed as a windfall and we too have the £500 clause so fingers crossed yours will be the same. We only started our IVA in April.
