the council have over charged me and are now offering a refund is this mine or do i have to hand it over to my iva
dont want to take it then be told i have to give some back

Hi Bobby I would check with your IP? Does that mean your I&E is now incorrect too? or was it a one-off overpayment?

its was over 2 years my income and expenditure has gone up this year not down that just softens the blow
not forgetting vat went up but my iva stays the same my car insurance is through the roof as well

£500 thats why i am asking its quite a lot massive mistake by the council as well

I believe a windfall of up to £500 is allowed in most IVAs...is this passable as a windfall guys?

Not sure, but my personal IVA proposal states up to 500.
Have you been over charged or have you over paid?

I think the best course of action is to have a word with your IP. If you have been over paying the council tax, this will have an effect on your I&E retrospectively, and it is down to your IP whether or not to seek to recover the retrospective, effective (phew) increase in your disposable income. If you see what I mean.

Unfortunately, you'll probably find your IVA Company will want the lot....after all had you not been paying it to the Council on your I & E, your creditors would of demanded it. Good luck.

Agree that the IP will probably want this but your I&E will need changing and going forward this gives you flexibility to increase your allowances in the other areas you mentioned so you will be better off. x
