Uff!

I am so furious for being sent a notice of breach for failing to provide documentation for my annual review when I have sent it in.

Yes I get they have called x times but everytime I call them back after the work I am always told that the person I need to speak to has gone home so I ask that they leave me a message with what the calls are about - but do they? Do they heck! Same old please call in we need to speak to you.

In fact I have called in twice and not once has anyone said we haven't had your documentation.

Argh! Then they have to cheek to email me to tell me they have issued me with a notice of breach - no prior warning nothing! Why can they email me this yet not email me to tell me they haven't had my documentation.

So I have forwarded them the original email that I sent as proof that I had sent it in and demanded they retract my notice.

What on earth are they doing I am only 10months away from completing I have the right mind to put in a complaint.

On a bit of rant sorry!

Don't worry about the rant - it's what we are here for!

Do you have any copies of the documentation for your review? If so I'd send copies via recorded delivery so they can't say they've not had them.

I'd insist on speaking directly to my IP as well rather than one of the office staff.

Hi

I emailed them over because its more convenient than finding a post office in London and my nearest one is not worth the trip.

I just started in a law firm and its so hectic I can't call during the day when my IP is available thats the issue which is why last time I called in I asked that my IP just leaves me a voicemail with what she wants grrrrr.

You can find a direct email address for your IP via the insolvency service website under the heading "find an IP" unless you dont alreay have a direct one

Thanks I'll keep that in mind for the future but I am just mad that we pay these fees to them to manage our IVA and they do this - surely my IP should make sure I have her email etc.

Anyhow I shall see how they respond to me strongly worded email. I just think they should of at least said you have xx days to get your documents in otherwise will be issue you with the notice.

Hi - I hope it helped to get it all out! It's so infuriating when these things happen.

I sent off my 18month review paperwork last week as I hadn't heard anything and got a call saying not to worry about the letter telling me I had two weeks to send it in or else because we crossed in the post. I never had the first letter requesting it in the first place!! It's great logic...send a letter and get no response, so send another letter rather than call or email to check up. They even know my post is hit and mostly miss.

hehe much better although i'll be in rant tomorrow if they don't agree with me! Its ok vent away your not hijacking at all.

Have you actually sent in the documentation, or is there some reason why you have not been able to provide it?

I have sent in documentation - I emailed it to them. Hence today I have forwarded them the email as proof that I had sent it in.

You should then ask for an apology for sending such a heavy handed letter. I have to say that mistakes do happen even in the best of firms, but when they do most of us like to set the record straight. I suspect a bunch of flowers may be coming your way soon!

Well just to update you after speaking to my IP - they say they cannot take the notice off my file just say its been remedied - didn't even get an apology! I am just looking forward to Dec when I will be done and dusted!

That's a shame when you have clear evidence that the documents had been sent to them. As you say - look forward and not back and the IVA will soon be over.

I'm glad it's sorted, but that's very poor service to leave the breach on file when it's actually their fault!

Good luck for the last 10 months x
