Hi experts

My IVA was arranged through Capital Insolvency Services, which itself went into admistration and was taken over by ClearDebt. The court case regarding that takeover is recorded in the London Gazette, and I, and CIS's other customers whose cases were transferred, are therefore listed by name in the gazette that's publicly accessible. (I only know this as I had cause to google myself and in doing so saw that I have a CCJ)

Is this right? I don't like the idea that you can access my personal information so freely.

I did contact the London Gazette and said I thought it breached my personal data protection - it's listing me as a CIS customer. They said they'd remove it, but it's still there.

I'd be really grateful for your advice.

I'm surprised that they have done this as an IVA isn't advertised in any paper. It is freely available on the Insolvency Register though.

Hopefully one of the professionals will be along to advise on this one.

As Kallis has said it shouldn't be listed in a newspaper however anyone can access the insolvency register at any time ! Don't let it worry you - you are on the right road to recovery and will soon be debt free !

Oh sorry - should have said: The London Gazette isn't a newspaper. Its a kind of data repository that publishes information. It's got an insolvency section that says it 'disseminates knowledge of insolvency events to those who need to know; and facilitates the re-use of the data by others'. It's not reporting on my CCJ as such, but instead it's reporting on the case around CIS going bust, and listing me as a customer of theirs. Which you can see by entering my name (or any of CIS's customers that cleardebt took over) in a bog standard Google search.

LuluJ & Jan thank you I am now, thankfully, debt free and the IVA is complete. But my public record remains there for all to see because it's listed through CIS

If the Court ordered that the transfer of appointments be recorded in the London Gazette then I am afraid there is little you can do about this. This would be quite normal, and as others have mentioned your personal information was recorded publicly on the Insolvency Register in any case.

If you really want to get the record updated, you may have to make your own application to Court which could be costly.

Thanks, Melanie. Disappointing to find out about. I know it's just a reality of life, but I'm really embarrassed by the IVA and haven't told anyone about it. Oh well, looks like it's out of my control.

The general public really do not interrogate the on-line London Gazette - so I guess there is probably a one in a million chance that someone would find you via that route. That said, don't be embarrassed about the IVA - feel proud that you did something positive about addressing your debts.

I'm not happy that I had to resort to an IVA as I blame myself totally, but I am glad that I am at last getting sorted out.

I have never looked at the London Gazette and it is probably not accessed anywhere near as much as the Insolvency register.

I doubt anyone will find you.

I think the more public element is that it came up on a google search of the OPs's name! I tried it myself but nothing came up...there is someone with my name who has a lot to say on onsolvency so even if I google my name plus insolvency you get pages and pages of this other girl!!

You google my name and I am a real estate agent, a singer, I have an asbo in Wales and I've written some books! Nothing at all about the real me!

I wouldn't worry too much about the London Gazette as I'm sure the majority of people haven't even heard of it.
