it's is looking very likey that my husband will be made redundant next week. my question is he will be given 10 weeks notice if they don't want him to work out his notice and he finishes work straight away can he start a new job before the 10 weeks notice period is up without paying back any redundancy pay.

We have an HR expert on board who will hopefully pick up on this. I am guessing the finer details vary from company to company. However, when I was made redundant, after getting the official Notice of Redundancy I was allowed to start a new job whenever one became available and not work out any notice, without affecting my redundancy pay. If they don't want him to work out his notice, they should still pay him for the notice period.

If it comes to this, 10 weeks is a fair amount of time to find a job. Do speak to your IP though and let them know.

It will depend entirely on the contractual terms. Generally if it is paid purely 'in lieu' of notice then he will be ok working elsewhere during this period. If however his employment contract has a clause relating to 'garden leave' during notice period this generally means you are still bound by the employment contract and whilst not being required to attend work during the notice period you are not able to work elsewhere. Check carefully as it could have implications re payment of redundancy pay.
