Hi ya does anyone know if it is possible to get out of a certain IVA company and go with someone else when you are really unhappy with the service your getting?

Hi Victoria,

Sorry to hear you're having problems with your IVA company. I don't think it's easy at all to change companies [:(]

What sort of problems are you haing and have you raised these formally with your IP? If so and you are still unhappy, then there should be a complaint process for you go through before contacting the relevant governing body.

I'm sure someone else will be along soon to give more advice xx

sorry to hear you're having problems, are you talking with your IP directly or a member of his/her staff? Sometimes it does help to talk directly with your IP. x

Hi ya my husband is the one in the IVA and he is with Blair Endersby
There have been problems from the start, like taking months to start it up and it taking 4 lots of paperwork before the information was correct.

Now after them not included a £7000 debt to his ex wife she is now taking him back to court for an attachment of earnings, after asking questions on here i found out it should have been included from the start and treated as any other debt as its not part of maintenance.
We got on the phone to them and they said they thought it could be included but that they thought the full amount has to be paid (thats not the advice on here)and that they would get back to us in a day.

This was a few days before christmas and there has been nothing back, we are in court on the 4th of january and now with no information so the judge will rule god knows what.

We never speak to his IP, its always some accountant.

Make sure that the judge is aware of your husband's IVA, and the fact that this claim predates the arrangement. I will be very suprised if an AofE is granted, but do let us know the outcome.

Even if it is granted, you shouldn't end up paying more money overall, because he would need to do a new I & E to reflect an extra amount coming out of his salary.

A repayment amount is already factored into their expenditure but they have been spending it so they will feel worse off.

A new I & E wont help as we are paying the minimum amount allowed which still leaves us £40 down every month, thats without anything extra like birthdays or christmas, or when the exhaust decides to fall off your car like mine did last week.

We are permanently in our overdraft which is getting more and more each month.

Also with regards to the ex, although £60 a month was agreed she now wants more with an interest rate of 8%.

Your ip can propose a variation to reduce your payments so you aren't £40 down before you even start each month. The worst they can do is say no. In the spirit of the new year and fresh starts it might be worth a go.
