if i take out an IVA is this information available to the public or confidential between myself and the creditors?

You will be listed on the insolvency register which is publicly accessible.

But you'd have to have some really nosey neighbours if they went to the trouble to trawl through it. Apparently it has to be publicly accessible so anyone you ask for a loan can check up on you. However, I don't recall ever checking up on anyone who I've ever loaned money too.

These days it's mostly used for scammers trying to talk you out of your IVA.

To be honest I don't think the majority of people even know the insolvency register exists.

My husbands family do think they are a cut above the rest of us-but on my checking the register to see if we were on it a couple of them were aswell!!!I do hope they check the register and realise we might have seen their names!!!Mind i wouldnt dare say anything to them!!!
And there i was worried about what people might think!!!Makes me chuckle to think the usual extravagant presents we receive for christmas from them may be replaced this year-i wont feel as bad when we hand over our meagre offerings -and to think i always felt so guilty about not being able to spend more on them!!!

Nobody I know has any idea about the register. The only thing you may have problems with is companies who trawl the register looking for people they can target to try and make money from.

I didn't know the register existed whether my friends do or not I'll never know as if they're on it they're not likely to tell me as I know two of our friends are on it but would never disclose I knew to them. x

I was ignorant of the register pre this forum and to be honest I only looked at it when hubby first entered an IVA and checked it after BR discharged.

Also bear in mind, some employment contracts have clauses relating to legal agreements with creditors.

It should be private and is advertised as such by a few companies but being on a database accessible to anyone is hardly private is it cant see why it has to be public at all

It should be private, but unfortunately it's not. We have tried to get it removed from public view but were unsuccessful.

I think it should be private. I understand banks and credit providers need to know if you are insolvent, however, it shouldn't be open to all.

That said, no one knew I was in an IVA (I worried people at work would find out) and within a few weeks of my IVA completing, the record is removed from the register.

The register has been unavailable for the past couple of weeks - long may that continue!

Hi all,

I am new to the forum and presently in the position of having an IVA proposed for me.

I must admit this register is one thing that I find a big "turn off" for entering into an IVA and did stop me 2 years ago from entering into one. I think an individuals credit and financial information should be kept private - on the same basis as Experian and the other CRA's, what additional benefit to anyone is there duplicating the info on a public reigister !?

If a business goes bust then that should be listed, but an indivdual person.

These companies who scour the register can obviously find personal info DOB address etc form this.

I am self employed / Company Director- I also have suppliers that I have dealt with for years who I don't think they would even check or know the existence of the register, but what worries me is if my clients were to check, clients to which we hold cash deposits for - how damaging could that be to my business ??
