My father passed away recently and I am due to inherit in the next month, which will be enough to clear my IVA. As it is a joint IVA with my husband, will my heritance be expected to pay off all of the debt or will an offer be acceptable? Just wondered if it made a difference as it my sole inheritance.

Thanks for you help

Hi, I'm sorry to hear of your father's death firstly

I'm unsure of the answer to your question but feel confident a professional will be along very soon.

Without further information it is impossible to answer your question accurately, but it is probable that your inheritance will be captured under the windfall clause. If that means that your IVA is concluded as a 100% return then so be it.

Consult your own IP, but it may be that, if there is any left over, a full and final offer for your husband may be acceptable.

Regards.

The windfall will only affect your IVA and not that of your husband, regardless of the fact that they are interlocking.
