A colleague of mine at work has been bragging that she is in an IVA and she has falsified inforation on her application which has been accepted and has been running for around 6 months now. Apparenlty she has 2 jobs but only declared one income on her income and expenditure, she has her other wages paid into a separate bank account that wasn't declared. Surely this should not be allowed to happen, this seems totally unfair to all of those who are totally honest in their applications.

You are absolutely right that should be the case and this person is not only making a mockery of the IVA process and those in it, but is also committing an offence. She is also very silly as this information is on record with HM Revenue and Customs so she could get into serious trouble.

For her sake I would advise her to come clean and speak to her IP before the IP finds out. Maybe if that did happen she would not be so smug.

I certainly wouldn't be boasting about doing that. She should have declared everything and been up front.

Just as a matter of interest Michael, would her IP company find out about this? Do they do any sort of checks while an IVA is running?

It would be possible to find out from HMRC if the P60 supplied to us was the only one issue in her name but that would mean checking up on all your clients and I think HMRC would tell us where to go. However, if they are aware she is in an IVA they will let the IP know but the real issue is trust. People enter IVAs to make their best offer to creditors and we should trust our clients. Idiots like the person referred to should not be allowed to blacken the process or those in IVAs.

An IP request for her P60 at review time would put her into the mire.... assuming that she isn't making things even worse by working "cash in hand" in her second job.

I totally agree Michael - the vast majority of us who are in an IVA are truthful and just want to try and get debt free at the end of the day.

Darkdog, you are right to include everything....people like guccipuppy's colleague will get their comeuppance ( oooh I sound like my mum [:D]). Aside from being dishonest they are not learning any lessons and possibly will end up back in debt.

I'm 100% honest and proud of it. I'm sure the friend of the poster will be found out eventually and then surely her IVA will fail and he/she will be back to square one.

No way would I be boasting about anything like that anyway! The less people who know about my IVA, the better!

Gosh - what a nerve! I'm getting all upset with the fact that my name will appear on the insolvency register.

In reality - if HMRC are not a creditor, no-one would probably ever find out about this. She is committing fraud and deception and has to live with that - but if I were here I would not be bragging too much about it. As in WW2 - Walls really do have ears.
