Have today just received Cashminder Account pack so will be dealing with transferring SOs and DDs, salary & pensions asap.

After speaking to IP (Mel N) she advised that it would be better for both myself and husband to file for bankruptcy.

I have phoned local County Court and requested 2 packs but haven't made an appointment yet (husband at work so need to agree date with him).

1. when the creditors telephone for their daily chat(s) - (phone off the hook for the last 3 days) - should we answer and tell them we are discussing a proposal for an IVA with an IP OR

2. that we are considering/will be filing for bankruptcy.

I am just worried that if I say we are going to go bankrupt somehow our bank (A&L) will get wind of this, particlarly as we haven't changed our bank account to Co-op.

My husband has just received a letter from Bank of Scotland to get in touch asap, added another £21 to his debt and threatened an "Agent" would be calling.

In the same post a letter from bailiffs acting on behalf of Royal Bank of Scotland requesting, oops sorry, DEMANDING £15,000.

Do we ring both and tell them 1. or 2 above.

Sorry if I'm rambling - panic attack (very very mild one!!)

Hi Pat. If creditors do call tell them that you are petitioning for bankruptcy and are saving up the money to pay for it. If they still demand ac payment tell them you cannot make preferential payments at this time but you could always ask the creditor to send you the bankruptcy fees to speed the process up. I doubt if they would but they might see the lunacy in chasing you.

Leaving aside the fact that only you can make that call, I would be tempted to say something along the lines of "I have spoken to xxxxx at xxxxx and am currently assessing my options before I make my next step. You will be notified of my intentions in writing in the very near future" I would then terminate the call.

All absolutely true, and I wouldn't pay them either, even only tokens, regardless of what they say on the phone or whether they try and tell you that the moon is made of green cheese etc.

Hi Pat,

What a stressful time for you.

It is entirely up to you what you do with the calls to your creditors. You can tell them what you are considering doing, don't enter into any arguments with them and then just put the phone down.

You can always write to them as well to back this up.

If you are considering BR, it doesn't matter how much the creditors add on, it will be written off and you don't have to answer the door to a Debt Collector anyway.

Hopefully it won't come to that.

Get your stuff changed over to the Co-op asap.

I can only confirm the advice from fellow experts and posters - a good idea for you to 'pop on over' to the sister site www.bankruptcyhelp.org.uk which you will find very helpful and full of people in a similar situation to you and your husband, or indeed further along the bankruptcy process. It is the County Hotel in Walsall. I don't have the number but am sure you could find it on Google. Would be great to see you MrBlueSky if you can make it.
