Hi all

Just got back from a weekend away to find some letters from Metropolitan Collection Services Limited (i think they are part of HSBC). We are in a DMP and so far everyone has been fine and accepted the offer. Only HSBC seem to have dragged their heels, finally things stated to seem like they were moving as we started getting letters from Metropolitan so we felt that things would start to proceed now, but the letters today don't read too well. they state they are disappointed we have not come to an agreement to clear the outstanding balance and as a result...... 'if you do not contact us (regarding full payment) immediately we intend to instruct DG Solicitors to issue legal proceedings and apply for a charging order against your property'

Is this a normal tactic used to scare people or is this something i should take note of?

Metropolitan are the in house collection service for HSBC; I have found them reasonable with samaritan clients I have dealt with; one tip- always send letters to them by recorded delivery - they are notorious foe claiming they have not received letters and I might add for mis-filing them.

We had our HSBC debts paid across to MCS and when we were in a DMP prior to the IVA.

MCS were fine, and then we were passed across to Robinson Way.

I wouldn't worry about the letters.

thanks Max, i am with Vincent Bond so they will be dealing with them, do companies ever take out a charge against a property and if so what can this mean? we are in the process of selling at the moment

Thanks Jan, i tend not to worry too much because as Andy keeps telling me, 'having no money to pay is a reasonably strong position to be in' !!! Just am a little worried as i could do without a charge on the property as we are trying to sell

All I can say that with my samaritan clients Metropolitan did not take Charging Orders - they accepted the proposals put forward without too much hastle.

They never took out a charging order with me, and Andy has given you good advice.

Vincent Bond will get you sorted with a DMP.
