Hi, we are now just into our 3rd year of the IVA in the first instance my disabled daugthers DLA (cerebal palsey)was included as income however, she is reaching her 16th birthday and the money will go directly to her in her own bank account, she will be using this for various things. she begins college in september as she cannnot work and there will be times i cannot collect her form there due to work commitments so taxis will be one expense, there will be books to buy,as well as a laptop so she can access the work that will be set (cannot write for ong as fingers tire) as well as the usual teenage things tht she as had to go without through no fault of her own (guilt as driven me mad ). I am just about to inform the IVA company , how will it affect our original proposal hoopefully we wont have to go bankrupt as there will be a drop in payment(if agreed) of around £270.00) per month. it is really beginning to worry me .can anyone advice on what they think will happen? thank you

After the IVA progressing for so long it is not in any ones interests to fail it. Speak to your IP and explain the situation I am sure they will be able to advise you fully. xxx

Did the original proposal forecast the drop in income when your daughter reached 16?

I would speak to your IP as sparklywatcher has advised as I am sure it is no ones interest for your IVA to fail. A variation may be the answer.

variations will depend on personal circumstances which we will not know... it may be that your IVA is extended to enable you to pay back over longer xx

I would deffinitely speak with your IP as technically, once your child is 16 the money is hers....unless you tell the DLA that she isnt capable of managing her own affairs which im sure you dont want to do.
As you re so far in, if the drop hasnt already been accounted for then your IP could call a variation meeting and ask for future payments to be reduced. I dont see why your creditors would refuse.

Hi, that would be great if they did that I will keep you posted i am awaiting the results of my daughters review (like shes gonna miracously get up n walk etc and not need any more help!) but it may be a while as they have requested hospital info whatever that means, thnk you for the support this site is great

Have a chat with your Supervisor (IP) as I am sure a variation to your IVA is now appropriate to counter these changes.

Just caught up with this.
I am sure your IP and the creditors will be sympathetic.

thnx for all the replies , i have taken them on board and as soon as I get my daughters review returned I will contact my IP . I wil keep you posted on the outcome, however it wont be for a wee while as they have requested more info from the hospital. thnks again x

I have a similar problem in that I have two disabled children and both of their DLA renewals are up in 3 years. I am just about to enter into an IVA. My daughter's should stay the same. But my son's I think will change. They will always both need high rate care, but my daughter gets low rate mobility and my son high rate mobility. He has always had to use a disabled buggy as he has problems with his legs and feet. (both of my kids have autism too and multiple other things). But thank the Lord after wearing pedro boots since he was 2 the hospital has now put in him in very specialised boots and splints in 4 weeks. I suspect by the time we get to renewal my laddy will be walking a lot better which is great news - but will bring my dla down for him. So thank you for bringing this up Merry as it has answered a question in the back of my mind.
Great news about your daughter going to FE - how fab is that! You must be very proud.

hey poppy you are very welcome, yes I am very proud of her however still a worry about personal care etc, do you know i wonder sometimes when will it end our children will always be disabled why should we be reviewed AGAIN ? by now they ought to have realised she will never walk or do alot of things abled bodied people can do, who writes these rules bet they dont have disabled kiddies - sorry rant over, I think this site is FAB I read different things daily that I hadnt realised b4. I am truely hoping that when I speak to my Ip my daughters benefits can stay with her or she wont lead the life of a normal teenage er which I feel truely guilty about as its my debt .
