IF A CREDITOR DOES NOT MAKE A CLAIM,ARE THE MONIES DUE TO THEM MERELY DISTRIBUTED AMONGST THE REST TO INCREASE THE FINAL DIVIDEND PAID?

If no claim is received, then those monies will go to the other creditors.

If the creditor doesn't make a claim and therefore does not receive money from the IVA, would they be able to ask us for the money during the IVA or once the IVA is completed?

Once your IVA is completed all debt is written off and no claims can be made by creditors

No, they would not be able to chase you for money after the IVA has finished, and whilst in the IVA they can't do it anyway.

I think it is unusual for a creditor not to claim though.

Thanks for that. Didn't want a creditor to jump up and bite me when I finally get through the next 5 years.

If a creditor never claimed and it was shared amongst the other creditors and there was enough to pay 100p in £ what would happen to any surplus?

don't think much chance of that with me though my proposal is only 22p in £ and thats by adding in my maintenance payments further on in. It will be a struggle but if we get accepted then we will complete the IVA.

my proposal was accepted on 6th April at 22p in £1. So sure you will be okay

Hope so, but I am a big believer in fate so whatever the creditors decide it will be there choice. If I get approved then I will give it 110% and if not then BR will have to be second option. Either way I will have sorted my debts out instead of worrying about them. Br does have a lot of draw backs for me but it's no good worrying about it. Work might have an issue about it but probably won't and they worst they can do is ask you to move on and at the end of the day it's not the end of the world.

David, thank you so much. I am ok my IVA will go through. But at the end of the day I will be happy whatever the outcome. Just been in the bath, But more importantly is there any news from the hospital I really hope J's mum pulls through this.
