One of my creditors, which was a joint loan with my ex-husband (£12,500 ish), hasn't given my IP proof of debt yet even though I'm 2 years into my IVA. I've already been told that this means they aren't liable for a pay out which would bring my IVA down considerably & would mean that I'm overpaying my total debt by about £5,000.

Me & hubby had an awful break-up & we only spoke via solicitors. I didn't even know he was ill with leukaemia until I heard it through a friend of a friend.

The reason that they may not have submitted proof of debt might be because they have been paid off by his parents while he was ill. He died last September, so they may have paid it off for him.

Would it be ok to contact the loan company to ask if it has been paid even though I'm still in an IVA? I don't trust my IP to tell me the truth. He won't actually talk to me personally even though I have left messages in the past for him to call & my situation is getting me extrememly confused and in a mess.

Please help.

Why won't he talk to you personally? Who on earth does he think he is - you are contributing to his salary cheque each month!

It is entirely in order for you to contact the creditor directly to see what the position regarding this debt it, if your IP will not do this for you. Which firm are you with as a matter of interest?

Hi Melanie,

I'm with Debt Lifeboat. Phillip allen is my guy. I've not been able to speak to him directly in the last 2 years. In fact I've never had a conversation with him. Only his colleagues. To be honest I gave up trying & have been emailing him for a quicker response to things.

Thanks for the advice. I'll contact my creditor direct tomorrow now. I'm in such a mess with this.

This firm are a www.iva.com recommended provider, who have had to demonstrate a certain level of customer service to be in such an esteemed position.

What a shame that Mr Allen is unable to take time out to help you resolve this matter.

Thanks David,although I've not approached him about this exact question yet because it only came to my mind this morning as I was talking about my last correspondence from him to my parents.

But, the fact remains that I've never spoken to him directly or been able to speak to him when I've asked in the past so have recently resorted to emailing him directly to get a speedier reply.

He isn't good at explaining things and I've actually learnt a lot more from this forum than I have from him.

I sent him an email on friday requesting another Statement of Affairs to exclude my old mortgage on it because I simply don't owe Northern Rock anything and my debts don't amount to £197,000,000 +.

Payplan are fine. Mine and hubbies IVA's are with them.

Payplan are not a www.iva.com recommended company, but appear to have a reasonable reputation from the people who they are assisting.

What was suggested to us was that if our IVA's were rejected, we could do a DMP temporarily and then try again in a few months.

Stueyspur23 - don't worry your firm are experienced enough and would not have put your proposal forward if they did not think it would get through.
