Melanie if you are there - got home late this evening so couldn't ring you and am off to leeds early in the morning till late tomorrow and can't ring whilst there. 3 months into IVA now and was feeling quite positive - all quiet and no creditors hassling me now- except got home tonight to find default notice from MBNA - I can just post this off to you. There is no telephone number for me to ring. They are asking for payment of £1288 by 21/10/08. I understand its probably a computerised letter but have they not told the robot computer that I am now in an IVA. I have to go out again but will check my posts later. I have enough stress again at the moment as Philip has just had more surgery and trying to deal with his creditors.

Hi Elizabeth - sorry to hear that you are having problems. Just send the letter over to Liz, but it is really nothing that you need to worry about. Thoughts are with you and Philip and hope the surgery helps.

I wouldn't worry about this its just a fairly standard procedure to issue a default notice. Just send it to Mel and forget about it thereafter.

Elizabeth, I really hope Philip is ok and the surgery went well. You really don't need all this creditor hassle but they will eventually stop. Thinking of you. X

they must be doing a bulk send because we got one too. i've also sent mine to Liz.

Hubby had one from MBNA today....19 months into IVA. I called them and apparently they've mistakenly sent letters out to all on their database.

What an enormous waste of paper and postage. They would have been better donating that money to charity!

Thanks for all the replies. Philip recovering slower than expected but then he did have more surgery than originally intended he just thinks "it wasn't much surgery" so should be better!! Plus I don't think the surgery will solve the problem anyway.

All these crazy letters sent by creditors when guys like you in IVA's is a disgrace. Their systems should be updated as they are firstly aware you offered an IVA, then their Agents voted for it and finaly it was passed and is now up and running.
In my capacity as a Board Member of the Debt Resolution Forum (DRF) if you all send me examples I will take it up with all their creditor representaives at the next IVA Protocol Standing Committee.

hi all - i have had similar letters from different creditors - i had one from Northern Rock about a CCJ and then another one from them to say they would take me to court!! i know i am one month into an IVA and i assumed i would still get the odd letter - i just pass them to my IP. still, it doesnt take away the worry! good luck.

These letters are bad and though a lot of us on the forum understand that we are protected by the iva, there are a lot of people in iva's that dont understand that they have this protection, and these letters can cause panic and distress, Maybe a few sneaking through during the first month post approval is ok, but I have received a couple 18 months into my iva, that shouldnt happen. Unfortunately David they were rung by me told quite sharply they shouldnt be sending them and became hamster bedding !!!

You can ring them and inform them that these letters are illegal and amount to harrasment and that you will report them to the OFT. Otherwise send me copies and I will take it up with the OFT to get them to remind creditors of their legal obligations. I know it is worrying receiving these letters BUT they cannot do anything. Keep your spirits high - your on the road to salvation.

How strange, i got one too, i had a horrid night shift last night and got home this morning to find a letter of default. Weird, i was so tired i couldn't deal with it. I do still have a card with a very small limit that i didn't include in the IVA as i thught i'd need one for emergencies, i don't so i may as well just get rid.

You should cut it up as it should have been disclosed originally.
