recently involved in a court case of a person owing us money around £4500. We won the court case of judgement against this person, now he informs us he is IVA,where does this situation leave us we have been pursuing monies owed since 2006 and only recently in 2008 has he became or becoming IVA.

Hi Heather and welcome to the forum
Your claim will be bound by the IVA on the basis that you are a creditor who ought to be entitled to receive the same dividend as the creditors bound by the IVA. You can find out which IP is acting for this person by searching on the Insolvency Service's website - Insolvency Register - and write to them to advise them of your debt, and to ask for a copy of the IVA proposals so that you can see what sort of return to expect.
