Hi, im new to forum and in need of advice. I would rather have an iva than bankruptcy, but all my debt is with Halifax so anybody know how the 75% voting rule would work??????

You need at least three different creditors to get an IVA approved so, if they are your only creditor, I don't think that you will find an IP who will take on your case, I'm afraid.

Hi bowie and welcome to the forum. If you only have one creditor then an IVA would not be suitable for you - you need to have a minimum of 3 creditors. Have you contacted the Halifax to try and come to an arrangement with them?

Oh dear, i suppose that bankruptcy is the only option then, as im not working at the moment then i could not make an arrangement with them that i could keep.

Do you have any assets - property, car etc? If not, BR would definitely be worth thinking about. Quite a few of us on here have done it so please ask as many questions as you need to. It would also be worth talking to the CAB to discuss your options.

Can I just correct that current acceptable IVA criteria is two creditors, but three different lines of credit. This still doesn't help Bowie, but wanted to make this clear.

Melanie you have answered my question that I had written down to ask your office today! My husband has two creditors but three lines of credit. Four if we count the joint overdraft. Thank you.

Hi, i went to see the IP today and they confirmed that BR is my only option. Only problem is, i took out a loan when i was living at my girlfriends mums house and i have been advised that as that was my previous address it will show up in the paper. my name in the family will be mud and it may end my r'ship, but ive got to do it but was just wondering what kind of people the OR are, the IP today told me that all of them will see me as a rogue until i convince them otherwise!!!!

Are you saying that a creditor is going against the TIX and proposed BBA/DBERR protocol? I can guess who you are talking about, and will discuss this with my client liaison manager at that firm on Monday. Personally I was suprised when the criteria was reduced from four separate creditors, but we have had new IVAs accepted under the new protocol.

no cover im afraid, i get 2 weeks pay at end of month, but the worst thing is that my landlady is my girlfriends mums boss!!!!! and i just feel that i will be dragged through the dirt lol, but hey, everything happens for a reason!!!

The Official Receiver's staff will only see you as a "rogue" if you have acted as one! If your debts were taken out in good faith, when you believed you could repay them, and events outside of your control have caused you to be in your current position, you can hardly be referred to in such scurrillous terms!
