I am thinking about entering into an iva, i am afraid my partner will be involved. all the debt (54,000) is in my name - except for one joint overdraft of £2000 with HSBC - does he have to be included?

Hi
No he doesn,t,as long as he can maintain payments[in full] on the joint overdraft.Your joint income and expenditure will be assessed but apart from that your partner will be excluded.

A lot really depends on how you are approaching this arrangement.
Is your partner going to be aware of the arrangement and if so is your partners income going to be included?
I agree that your partner does not have to be included in the arrangement.
However as the HSBC account is in joint names, I do believe that HSBC will have to be advised of any proposed arrangement, as one of your creditors.
You don't want to really think of NOT advising them as they will find out.
Ultimately it may well be down to them how they react to the news of a potential IVA. They could take deposits in to the account and freeze it once the account is back to nil and ask you to make alternative banking arrangements.
