Hi not moanin my IVA was approved..YEH!!.i had about eight creditors...two voted for and one against...and the others didn't vote which is good as two others i had a big debt with and could of pushed the IVA so i couldnt get one..my question why dont some creditors bother to vote just out of interest..thanks in advance..

Because they cannot be bothered?

Because they are inundated with work?

Because they are happy to go along with the decisions made by other creditors?

And probably a few more reasons as well.

some of my creditors voted but not others. With my joint debts they voted on my husbands but not mine, so I was lucky some didn't vote otherwise mine would have been turned down as I would not have had enough votes if one had said no.

It also amazes me why some of them don't. If the debt is a small one sometimes their agents can't be bothered to respond.

Sometimes they might not have received the proposal!

Hi David and Melanie, do the creditors have any recourse if they claim they have not received the proposal? Do you need to send them recorded delivery? Is this not open to abuse (i.e. a less scrupulous IP may 'forget' to send to a particular creditor)

The only recourse they have is to go to court and attempt to prove that there has been a material irregularity - which I doubt is sustainable.

We keep a postal record which is signed to confirm to whom all proposals have been sent.

Not necessary to send by recorded delivery.

Could be open to abuse but that IP would eventually be found out and the regulators would know what to do with him/her.

Hope it stays that way - the forecast is good - been overcast here in Spain with a few drops of rain - then the sun - sunny at the moment though.
