We have been in a iva for over eighteen months we have just had a letter from somebody calling themselves The iva council are they for real or just another company trying to make money out of our situation
which is dire already?

They are a consumer group who claim to be representing parties who feel that they have been "mis-sold" and IVA.
Can you clarify why your situation is dire, and perhaps some of the experts and other forum members could offer some advice.

The IVA Council are known to search through the insolvency register and send individuals who are in IVA's letters asking them whether they have been "mis-sold" an IVA.
I dont think the IVA Council are as concerned for the individuals as they make out. In their letters the ask clients to stop making their IVA payments and hand over 3 payments to themselves for their representation. This is clearly a cause for concern as they are causing doubt in people's minds about IVA's and then asking them to stop making payments which is a very serious matter.

I am glad I have found this forum, as if my iva is accepted, then i will always remember the IVA council for if and when i receive a letter, I can just file it in the dustbin. Without this forum and its info, i would have received the letter and panicked.

I find the suggestion of making people to miss their IVA payments to be unlawful (ie IVA is registered with the Courts) and perhaps we should report this matter to the Trading standards office!

First off i must apolagise as my computer skills are not that hot
My situation is that my wife and i have been in an iva for over eighteen months we have a morgage of £470 a secured loan £516 and an iva costing us £670 monthly this squeezes us till we hurt and while this was bad we somehow managed, but my wife has been diagnosed with cancer and has not worked since July i have been off work with stress and as we both work for the NHS we get payed at moment but well you can see why i say sitiation is dire!!!!
I have not informed my IP yet because they just seem to want to squeeze us for more money and well its hard enough now.
gee i cant believe im doing sorry i will come back later this is hard.

Hi Glen
First of all let me say how sorry I am to hear of your wifes diagnosis, I have been through this situation with a very close family member and I know just how worrying and stressful this is.
I wish you both well and hope any treatment is succesful, and also you get help with your stress. When I was going through it with my mother I was off work for a long time and got so stressed and it made me ill also, so take care of youself also as she will need your support as I am sure you are finding.
My advice with the situation with your iva would be to speak with your IP as soon as possible as you may find they can do something to help you. I have heard it is sometimes possible to take a payment break and add this onto the end of the term of the iva.
i am sure any IP and creditors would look at your case with sympathy and try to help if they can.
I would await advice from an expert but wanted to wish you well

Hello Glenn,
I think Emma is absolutely right.
You should speak to your IP as soon as you can. Your IP will not want your IVA to fail and your IP will understand that your personal circumstances have changed in a way that you could not have predicted.

I would say the same as Emma talk to your I.P if he is not helpful then all is not lost talk to someone in the hospital a private Governing body for the N.H.S.
Glenn i know its hard but you need to be in control not for your sake but your wifes.
Glenn words cannot help you but some advice might help also talk the C.I.B.

Your IP has a duty of care to you to ensure that you continue to receive best advice during the IVA and that he gives whatever assistance possible in order to try and sort out your problems.
Would it be possible for you to try and consolidate the secured borrowings on your property to avail of lower repayments, or maybe seek a variation of the terms of the arrangement to accomodate lower payments.
If your IVA has been taken out fairly recently, you may even have the ability to reduce payments by up to 15% if your disposable income has dropped without the need for formal variation procedures, so I suggest you get your IVA papers out and have a good read through them.

I am so sorry about your situation, how much stress you must be under?
I feel that you should tell your IP, and tell him/her what you need to happen. This is not the time to feel 'squeezed'. Life is far more important than money, thats how I see it.
Whats the worst thing that can happen?
