You've got to laugh - I've just received a default notice from Tesco Personal Finance! Apparently I owe them £2184.49 and I'm in arrears by £774.
What do I do with the default notice? Do I send Tesco a copy of my BR notice or do I just send the default notice to the OR?
Also, I have just checked my credit file online and Tesco actually defaulted me last November (a month after my IVA was agreed) - can they default me twice?
Lastly (sorry for all the questions!), how long will this stay on my credit record for? Don't get me wrong, I don't want credit, but I was hoping to be able to clean up my credit record after the BR drops off in 6 years time (and hopefully get a new car which might require finance), but if the default lasts for 6 years that's another 6 months to wait!

Hi Skippy
That,s the danger that a creditor defaults you and it sits on your file for six years.I would contact them and send through a copy of your bankruptcy.It is probably an oversight on their part.However you do not want them defaulting you next year etc

Sorry Andy, your reply wasn't there when I posted again!
I'll put a copy of my BR notice in the post to them tomorrow. Do you think I need to send the default notice to the OR as well? I don't want to draw attention to myself there as a few weeks ago I had to send them an IPOQ due to a pay rise!

Well skip,
I really dont know the answer but you could send it back with the BR number and send a copy to the OR or ring the OR and ask what you should do???
Sorry I cant be of any help, hopefully one of the experts might know.

Thanks Lily. I've just rung the OR's office and they have advised me to send a copy of my BR order and a covering letter to Tesco. I haven't drawn attention to myself - they didn't ask for my name so I didn't give it! I'll get the letter in the post tomorrow, but in the meantime does anyone know if Tesco are likely to overturn the default or am I stuck with it?

This gets better - I have just spoken to the muppets at Tesco (sorry, that's an insult to Kermit and Co!) and they have told me that there is nothing they can do, the default will be issued UNLESS I CLEAR THE ACCOUNT!!! I explained to him that even if I could pay the balance it would be illegal as I'm bankrupt, and he told me that it doesn't matter, even if I make a payment of £1 it will stop the default. I then very patiently explained that I am bankrupt, therefore I'm NOT ALLOWED to pay and he told me not to worry, someone will be in touch with me soon to make arrangements for me to pay!

Oh I've just written a lovely long letter to the "Manager, Customer Assistance Collections", a Mrs Angell pointing out a few facts.
I feel my Tesco boycott coming on again! I had weakened and bought a Krispy Kreme doughnut in there but I will stand strong! I hate Tesco with a passion - I had car insurance and they screwed up the payment (they couldn't find the car that was parked outside my house!), I put their dodgy petrol in and needed new sensors in the car and now this!

Give to them straight, tell them to shove the default in a certain anatomical dark region. You ahve been in an IVA a bankrupt for 6 months and they have only just decided you broke your aggrement? If they do take action its probably going to be sometime in the next ice age. Now I know why you hate tesco, I always wondered.

You have spoken to someone in Tesco who clearly doesn,t understand the whole insolvenct issue.A covering letter,sent with a copy of your BK,asking for a reply should do the trick.
I wonder if Storm can give a view if he,s online.

The letter is ready to go! I've basically told them I'm not happy with the level of service and that I don't expect the default to stand. I doubt if it'll get me anywhere, but I like a good arguement, especially with the devil's own brand!

Skip - give them hell!!!
I just had a letter from them - (my pet insurance and house insurance is with them) --- my pet insurance has gone up from £23 a month to - wait for it --- £49!!!!!
I wonder what they are up to ????? ......... Hmmmmmm ........
