An article I read this morning states that debt collectors, particularly debt purchasers are chasing the debts of people in IVAs or have been declared bankrupt; they are also claimed to chase people for the portion of the debt written off after completion of the IVA. Is this legal and if it happens what can be done about it?

The short answer is that they cannot chase for these types of debts, as they no longer exist, and once informed should not contact the person again. You might suspect that the more unscrupulous agencies out there would still continue to do so, possibly to cash in on peoples inertia/ignorance, but there really is nothing to worry about. There are avenues to pursue harassment cases of course but they do tend to be costly.

Thank you - a very well known one was mentioned who use a well known London firm of solicitors - from what you say it could be the article was written with little regard for the legalities.

The best thing to do would be to ignore them once you have told them that you owe them nothing. They can't do anything to you.

It was in a quality mag in the GPs waiting room - also said that medics and dentists are topping the debtors lists!

Size5 - I'll go back to the GP tomorow (he is closed now) and see if the mag is still there. They tend to get removed by patients!
