Sick pay

An employment law question for anyone who can help. I've just been signed off work for a few days by my doctor due to illness. This is only short term. If I request my employer to pay me these days as holiday, can they refuse? I'm hoping to get signed back on ast to work before SSP comes into play.

Don't see any reason why you can't take leave rather than go sick - I know some people who have done that although not recently.

I get paid whilst off sick so my SSP is reclaimed from me by my employer. I take it that doesn't happen with you?

Sorry to hear you are not well. If the company does not have it's own company sick scheme are you eligible for SSP?

Anyone who is off work sick, should be recorded as such in order for appropriate support if necessary to be offerred and to record figures correctly.

Of course, depending on the company, this can still be done, but holidays used if the employee requests and signs an agreement. From a company point of view, you couldn't force someone to use holidays instead of sickness, but discretion can be used the other way around.

My hubby is having an op on April 13th (Friday) and he's having two weeks holiday instead of sick pay as we can't manage being in an IVA and all that...his bosses were fine with it, should he need a 3rd week well we'll take that one day at a time but I've already asked my IP for permission for a payment break if he doesn't get paid for the 3rd week (which he won't if he doesn't work).
